Rule 134
Disability
: (1) If a police officer is physically or mentally disabled to continue in the police service due to an accident or trauma while performing the duties of his post or in the course of training, or is physically or mentally disabled to continue in the police service for as long as such police officer survives for his livelihood, the sub-rules ( 2) will get disability allowance as written in sub-rule (3) along with pension. Explanation: For the purposes of this sub-rule, mentally disabled means a person who has been recommended by the medical board constituted by the Government of Nepal as mentally disabled and unable to work in the police service.
(2) According to sub-rule (1), if the service period of a police employee who is disabled has reached the period of getting pension, he/she shall be paid immediately (including if he/she has worked as a permanent, caretaker or substitute) salary as per sub-rule (2) of rule 131. He will get a disability pension equal to the coming amount. If the service period of such a disabled police officer is less than the pensionable period, according to this regulation, the remaining amount will be deducted from Damasahi for every full or half-year before reaching the pensionable year. When deducting in this way, more than one third of the amount will not be deducted.
(3) The amount of monthly disability allowance that the police employee will receive in addition to the disability pension due to disability according to sub-rule (2) shall be equal to twenty percent of the salary he has earned. In addition, in the case of disabled police personnel as written in (a) of the explanation section of rule 138, twenty percent of the disability allowance received by him throughout his life will also be given additional facilities as curuwa expenses. However, if a police employee who has received or is expected to receive disability benefits is later re-entered into any service, he will not receive disability benefits according to this rule and the amount of disability benefits that he has received will not be refunded.
(4) Notwithstanding anything contained in sub-rule (1), any police officer shall be engaged in the action of an armed group or any armed encounter or attack, explosion or armed group orSimilarly, in the event of an accidental accident while engaged in action against other groups, or incapacitated for the purpose of police service due to injury or injury of any kind of weapon, such police officer will be promoted one level and retired from the service and he/she will be retired from service for a maximum period of seven years without exceeding the age limit. After the period of receiving full salary has passed, the police personnel whose service period is less than the pensionable period will get the same pension and the police personnel whose service period is more than the pensionable period will get pension accordingly.
(5) In accordance with sub-rule (1) or (4), the concerned police personnel shall receive the full amount of the expenses incurred for treatment of injuries and such treatment expenses shall not be deducted from the treatment expenses received as per sub-rule (1) of rule 141.
(6) When the salary of a police employee of the same position is increased during the period of benefit according to sub-rule (4), the salary of the retired police employee will be increased by the same amount as the increase in the starting point of the salary.
(7) In the event of death of a retired police officer who has received benefits under sub-rules (1), (2), (3) and (4), his family shall receive all the benefits in the same manner as he received until the completion of seven years of such benefits and after the completion of seven years, the rules According to sub-rules (1) and (2) of 135, he will get pension.
(8) When there is an increase in the salary of an existing police employee, the same percentage increase in the amount of the starting point of the salary of the police employee of the same level will also increase the amount of the disabled employee according to sub-rule (3).
(9) For the purpose of providing disability, the Ministry will provide a certificate of disability.
